1. ACCEPTANCE OF TERMS
By accessing or using the LiveMela mobile application or any associated service (collectively, the
"Platform"), you confirm that you are at least 18 years of age (or accessing under the supervision of
a parent or legal guardian), that you have read and understood these Terms, and that you agree to
be bound by them. If you do not agree to these Terms, you must immediately stop using the
Platform.
2. ABOUT LIVEMELA
LiveMela is a live-commerce platform that allows:
• Users to watch live selling events, discover products, and redeem discount coupons at
participating merchants and restaurants.
• Sellers to host live streaming events and sell products directly to viewers.
• Merchants to list their businesses, issue coupon booklets, and manage redemptions through
the Merchant Portal.
LiveMela operates as an intermediary marketplace and is not a party to any transaction between
buyers, sellers, or merchants unless expressly stated.
3. ACCOUNT REGISTRATION
To access most features you must create an account by verifying your Indian mobile phone number
via OTP. You agree to:
• provide accurate and current information;
• keep your account credentials confidential;
• immediately notify us of any unauthorised access to your account;
• not create accounts using automated means or under a false identity.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in
fraudulent activity.
4. MERCHANT ACCOUNTS
Businesses wishing to list on LiveMela must apply for a Merchant Account. Approval is at the sole
discretion of LiveMela. Approved Merchants agree to:
• honour all coupons and booklets they issue or that are associated with their business on the
Platform;
• maintain accurate information about their business, offers, and validity periods;
• not attempt to circumvent or falsely redeem coupons;
• comply with all applicable Indian laws, including GST regulations.
LiveMela may charge a platform fee on booklet sales. Fee percentages are communicated at the
time of onboarding and may be updated with 30 days notice.
5. LIVE STREAMING & EVENTS
Sellers may host live selling events on the Platform subject to our content policies. By hosting an
Event, you:
• grant LiveMela a non-exclusive, royalty-free licence to stream, record, and promote the
content;
• confirm that all products shown are genuine, legally available for sale, and accurately
described;
• accept sole responsibility for product delivery, quality, and any disputes with buyers.
LiveMela may charge an event creation fee. LiveMela reserves the right to remove or end any live
stream that violates these Terms or applicable law.
6. COUPONS & BOOKLETS
• Coupons are discount vouchers valid at specific merchants or restaurants.
• Booklets are curated collections of coupons sold at a discounted bundle price.
• Coupons and booklets have fixed validity periods and cannot be extended.
• Each coupon can be redeemed once only. Redemptions are final and non-reversible.
• A coupon is void if tampered with, duplicated, or transferred in violation of these Terms.
• LiveMela does not guarantee product or service availability at the time of redemption.
• Merchants are solely responsible for honouring coupons.
• Expired or already-redeemed coupons will not be replaced or refunded.
7. PAYMENTS & REFUNDS
Payments on the Platform are processed via Razorpay, a third-party payment gateway. By making
a payment you also agree to Razorpay's terms of service.
• Coupon booklet purchases are non-refundable once the payment is confirmed, unless a
technical error on our part prevented access to the purchased booklets.
• Event creation fees are non-refundable.
• For product purchases made during live events, refund and return policies are set by the
individual Seller.
If you believe you have been incorrectly charged, contact support@livemela.co.in within 7 days of
the transaction.
8. USER-GENERATED CONTENT
You may post content such as comments, reviews, or participate in live chats. By doing so, you
grant LiveMela an irrevocable, worldwide, royalty-free licence to use, display, and distribute such
content on the Platform. You confirm that your content:
• does not infringe any third-party intellectual property rights;
• is not defamatory, obscene, hateful, or unlawful;
• does not contain spam, phishing links, or malware.
LiveMela may remove any content at its discretion without notice.
9. PROHIBITED ACTIVITIES
You must not:
• use the Platform for any illegal purpose under Indian law;
• sell counterfeit, stolen, hazardous, or prohibited goods;
• attempt to reverse-engineer, scrape, or clone any part of the Platform;
• create fake accounts, fake reviews, or manipulate ratings;
• interfere with the security or integrity of the Platform;
• use automated bots or scripts;
• harass, threaten, or abuse other users or merchants.
Violation may result in immediate account suspension and referral to law-enforcement authorities.
10. INTELLECTUAL PROPERTY
All content on the Platform including the LiveMela name, logo, interface design, source code, and
proprietary algorithms is owned by or licensed to LiveMela and is protected under applicable Indian
and international intellectual property laws. You are granted a limited, non-exclusive,
non-transferable licence to access and use the Platform for personal, non-commercial purposes
only.
11. PRIVACY
Our Privacy Policy explains how we collect, use, and protect your personal data. By using the
Platform, you consent to data practices described in the Privacy Policy.
• We collect phone numbers, usage data, and transaction information to operate and improve
the Platform.
• We do not sell your personal data to third parties.
12. DISCLAIMERS
The Platform is provided "as is" and "as available" without warranties of any kind, express or
implied. LiveMela does not warrant that:
• the Platform will be uninterrupted, error-free, or secure;
• products or services offered by Sellers or Merchants meet your expectations;
• coupon discounts will be applied correctly by merchants.
Live streaming quality may vary depending on your internet connection and device.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, LiveMela and its directors, employees, and
partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages
arising out of or related to:
• your use of the Platform;
• any transaction between you and a Seller or Merchant;
• unauthorised access to your account;
• or loss of data.
Our total aggregate liability to you shall not exceed the amount you paid to LiveMela in the 3
months preceding the claim.
14. GOVERNING LAW & DISPUTES
These Terms are governed by and construed in accordance with the laws of India. Any dispute
arising out of these Terms shall first be attempted to be resolved through good-faith negotiation. If
unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of
Mumbai, Maharashtra, India.
15. CHANGES TO THESE TERMS
We may update these Terms from time to time. Material changes will be notified via the app or
registered phone number at least 7 days before they take effect. Continued use of the Platform
after the effective date constitutes your acceptance of the revised Terms.
